Our text messaging program is optional. By submitting the opt-in form and checking the consent box, you confirm that:

  • You are the subscriber or customary user of the mobile number provided;

  • You consent to receive texts and calls, which may be sent or placed using automated technology, from Intersect Acquisitions for the purposes described on our website;
  • You understand that message frequency varies; typically up to 4 messages per month.
  • Message and data rates may apply;
  • Agreeing is not a condition of selling a property to us, and you can email us instead;
  • You have read our Privacy Policy.

Forbidden content (illegal activity, deceptive offers, prohibited lending promotions, etc.) is not permitted in our program.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INTERSECT ACQUISITIONS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE WEBSITE OR SMS PROGRAM. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER.

You agree to indemnify and hold harmless Intersect Acquisitions LLC from claims arising from your misuse of the website or SMS program or violation of these Terms.

9. Governing law

These Terms are governed by the laws of the State of South Dakota, without regard to conflict-of-law rules. Any dispute arising from or relating to these Terms, the website, or the SMS program shall be brought exclusively in the state or federal courts located in South Dakota, and you consent to the personal jurisdiction of those courts, unless otherwise required by law.
